His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, in his capacity as Ruler of Dubai, on Monday dissolved by declaration an exceptional council for settling disputes with real estate specialists.
The special council was formed in 2009 after the global financial problem over a decade ago to settle disputes in relation to mortgage firms Amlak Finance and Tamweel.
The court had the jurisdiction to consider and adjudicate any request or case submitted against Amlak Finance and Tamweel or any of their auxiliaries, including liquidation and dissolving demands.
“Pursuant to the decree, all complaints and lawsuits that have been reviewed by the Special Tribunal and haven’t received a final judgment will be referred to the concerned Court of First Instance at Dubai Courts,” a statement on Sheikh Mohammed’s website said.
The new announcement dissolves Decree No. (61) of 2009 and whatever other enactment contradicts or difficulties its articles. The declaration is dynamic from its date of issuance and will be distributed in the official gazette.
Dubai offers a wide range of debate resolution strategies and relevant authorities administering real estate wherein the litigation courts appear to be a final resort for the parties, considering the course of events and expenses included.
Prominent authorities authorized to follow up on real estate disputes incorporate Dubai Land Department-Amicable Settlement Center; Legal Affairs Department of DLD; Cancelled project committees for liquidation; Judicial Committee for returned checks; Rental Dispute Settlement Committee; Dubai International Arbitration Center; and Civil Court-Property Division.
