A new real estate leasing law was drafted in Sharjah, modernizing the regulations that covered the rights of landlords and tenants as well as the purchasing and selling of real estate within the Emirate.

Following the introduction of several amendments to the draft law during the sixth meeting of the first regular session of the eleventh legislative term, the Sharjah Consultative Council (SCC) approved a draft law for the year 2024 regarding real estate leasing in the Emirate of Sharjah. Dr. Abdullah Belhaif Al Nuaimi, the Chairman of the SCC, presided over the meeting.

In the presence of Counselor Dr. Mansour Mohammed bin Nassar, Head of the Government of Sharjah’s Legal Department; Issa bin Hanzal, Director of the Government of Sharjah’s Legal Department; and from the Sharjah Municipality, Khalid Falah Al Suwaidi, Director of Customer Service; Abdullah Ibrahim Shuhail, Director of the Rental Regulation Department; and Muhammad Ali Al Ridwan, Head of the Judgments Implementation Department, the Council discussed the draft law on real estate leasing and reviewed the report received by the Council’s Legislative and Legal Affairs, Appeals, Suggestions, and Complaints Committee.

Counselor Dr. Mansour Mohammed bin Nassar, Head of the Legal Department of the Government of Sharjah, gave a speech in which he praised the role of SCC in completing the legislative cycle of draft laws. He stressed the importance of the current draft law as it represents a work system that adds to the gains of the Emirate of Sharjah and its keenness to regulate the relationship between landlord and tenant, by the laws in force in the city of Sharjah.

Since the previous law was issued in 2007, which makes it about 17 years old, it is necessary to amend it to keep up with developments and meet the needs of the parties. He pointed out that the Emirate of Sharjah is an attractive environment for families and investors, so strong laws and legislation were created to regulate the trading of real estate, including buying and selling, and other real rights. All of these matters will be regulated by the draft law.

The draft law on real estate leasing is crucial, according to Khaled Falah Al Suwaidi, Director of Customer Service at Sharjah Municipality. He noted that the law includes regulating articles that represent the goal of improving the Emirate of Sharjah’s appeal to tourists, investors, and residents.

Al Suwaidi emphasized that the draft law’s current language addresses societal living conditions and unites all pertinent parties in a well-organized framework that keeps up with changes and demand in the Emirate of Sharjah’s real estate market.

A draft law for real estate leasing in the Emirate of Sharjah for the year 2024 was read aloud by Hamad Abdel Wahab Al Qawadi, Rapporteur of the Council’s Legislative and Legal Affairs, Suggestions, Appeals and Complaints Committee. He went over the definitions, objectives, competencies, and other legal articles mentioned in the draft law.

Members talked about all of the law’s goals and provisions, all of which are meant to control the relationship between a landlord and a tenant.

Members offered a range of perspectives regarding the draft law’s articles during their interventions, and government representatives addressed questions by outlining the legal interpretation of the law’s provisions as well as the work involved in putting it into practice.

At its fifth plenary session, the Council approved a draft law for the year 2024 concerning real estate leasing in the Emirate of Sharjah. This draft law is the second one the Council will discuss when it starts its work for the eleventh legislative term.

The Council’s Secretary-General, Ahmed Saeed Al-Jarwan, declared after the meeting that the Council’s recommendations concerning the Sharjah Tourism and Commerce Development Authority’s policy will be the subject of the following meeting.
