Mohammed Bin Rashid creates a special tribunal to solve the problems over inherited property

Dubai: His Highness Sheikh Mohammed Bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, is creating a special tribunal to solve the problems between heirs in relation to the deal of inherited residential property.

The decision focuses to  “protect the rights and interests of all concerned parties, especially the elderly, minors, femes sole, divorced women, widows and people of determination,” according to a statement from the Dubai Media Office.

Members of the tribunal will have legal, financial, and real-estate experts. The Chairman of the Dubai Judicial Council will name the president of the special tribunal, it further said.

What will they do?

The special tribunal will settle and issue rulings on problems between heir in regard to the deals of inherited residential property confirming to Decree 23 of 2020 controlling the deal of Inherited Residential Properties by Heirs.

The special tribunal will likewise settle and issue decisions on requests against the choices and procedures issued by the Department of Land and Property in Dubai or the Mohammed bin Rashid Housing Establishment.

If the act of partition of the inherited real property is not possible, or otherwise if the act of partition of the inherited real property will cause a problem or notably decrease the value of the property, the special tribunal may auction the inherited real property and probably distribute the money between the heirs.

In all its decisions and legal actions, the special tribunal must respect the articles of Federal Law No. (11) of 1992, as altered, and reserve the rights and interests of heirs. The special tribunal will not acknowledge or audit any case except if the applicant or the offended party presents an authoritative report demonstrating the beneficiaries couldn’t reach an amicable settlement.

Will not review

In accordance with the choice, all courts in Dubai, including DIFC Courts and other unique councils, won’t survey any request of or bid identified with disputes between beneficiaries comparable to the offer of acquired private property after the initiation of this choice.

All decisions, choices, and orders given by the special tribunal council are final and incontestable, and the Execution Court in Dubai will properly execute the decisions, choices, and orders issued by the special tribunal. The special tribunal will practice its authorities pursuant to the Laws and enactments applied in Dubai and Sharia Law.
