A new inheritance court has been established in the UAE to ensure that social and family relationships are protected in such circumstances. Its goal is to settle inheritance-related claims quickly.

Sheikh Maktoum bin Mohammed bin Rashid Al Maktoum, Deputy Ruler of Dubai, Deputy Prime Minister, Minister of Finance, and Chairman of the Dubai Judicial Council, announced the establishment of the special court on April 17.

But what types of cases will the court hear, and what will the litigation procedure entail? Here’s what all is included in it.

What is the purpose of the new inheritance court?

The new court will handle inheritance cases such as inventory listing disputes, inheritance liquidation or distribution among heirs, and civil, real estate, commercial, and other actions originating from inheritance conflicts.

The court has been established under Dubai Courts and will be dedicated to dealing with inheritance matters worth at least Dh500,000.

A Court of Cassation judge will preside over the inheritance court, which will also include a Court of Appeals judge and a Court of First Instance judge. The special inheritance court would bring together justices with various specializations depending on the nature of the case.

What method will be used to hear cases?

The court’s preparation period for cases considered by the court shall not exceed 30 days from the date of registration, according to the notification.

Unless the judge presiding over the case determines differently, the litigation procedure should not last more than 12 months.

Is it possible to appeal the decision?

According to a statement made on April 17, the court’s decisions would be final and not open to appeal through traditional channels.
